Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the Hysel platform, including research tools, AI features, and influencer discovery. By creating an account or using Hysel, you agree to these Terms.

If you use Hysel on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. What Hysel does

Hysel is an independent analytics and productivity tool for e-commerce sellers. Etsy shop data is retrieved through the official Etsy Open API v3 with your authorization. Keyword and market figures may be estimates and are labelled as such.

We are not affiliated with, endorsed by, or certified by Etsy, Inc.

3. Your account

• You must provide accurate information and keep your credentials secure.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to use Hysel.
• Notify us immediately at hysel.studio.io@gmail.com if you suspect unauthorised access.

4. Acceptable use

You agree not to:

• Use Hysel to violate the Etsy API Terms of Use or Etsy's policies.
• Attempt to retrieve marketplace data by any means other than the official API, including screen-scraping or automated crawling of third-party sites.
• Resell, redistribute, or provide raw Hysel data to third parties as a competing service.
• Reverse engineer, decompile, or probe Hysel's infrastructure.
• Use Hysel for unlawful purposes or to infringe others' rights.

5. Etsy API usage

Hysel integrates with the Etsy Open API v3. We comply with the Etsy API Terms of Use, including:

• Caching policies — Etsy data is cached only within the retention periods defined in the Etsy API Terms of Use, after which it is refreshed or removed.
• OAuth authentication — access to your private member data is granted only through OAuth, with the minimum permission scopes required for the features you enable. You can revoke access at any time from your Etsy account settings.
• No circumvention of the API — Hysel never sidesteps the API to retrieve or post Etsy data.
• Attribution — the term "Etsy" is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.
• Trademark policy — we also follow Etsy's Trademark Policy in how the Hysel name and artwork reference the platform.

6. Subscriptions and payment

Some Hysel features require a paid subscription. Subscriptions bill in advance on a recurring basis until cancelled; you can cancel at any time and keep access until the end of the paid period. Where applicable, taxes are added at checkout. If you believe you were charged in error, email us within 14 days and we will review it. Mandatory consumer-protection rights in your country of residence still apply.

7. AI-generated content

Hysel's AI features (listing generation, keyword estimates, image generation) produce content for you to review. Estimates and AI outputs may be inaccurate and are clearly labelled in the product. You are responsible for reviewing and approving anything you publish to your marketplace listings.

8. Influencer data

Creator and influencer information in Hysel comes from third-party data providers and public sources. We do not guarantee that it is accurate, complete, or current. You must use it lawfully, comply with each social platform's rules and with applicable anti-spam and marketing laws when contacting creators, and must not scrape or bulk-export it.

9. Intellectual property

Hysel retains all rights to the platform, its design, and its software. You retain all rights to your own content, shop data, and listings. You grant us a limited licence to process your content solely to provide the service to you.

10. Disclaimers

Hysel is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that research figures, estimates, or AI outputs are complete, accurate, or error-free, and we do not guarantee uninterrupted service availability.

11. Limitation of liability

To the maximum extent permitted by law, Hysel and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

12. Termination

You can stop using Hysel and delete your account at any time. We may suspend or terminate accounts that violate these Terms or the Etsy API Terms of Use, with notice where practicable. On termination, your data is handled according to our Privacy Policy.

13. Changes and governing law

We may update these Terms; material changes will be announced through the app or by email before they take effect. Continued use after the effective date means you accept the updated Terms.

These Terms are governed by applicable law, without prejudice to mandatory consumer rights in your country of residence.
